Garrett's Charity (Registered Charity 1053847)

The charity intends to change the purpose of the Heritage Rooms formerly known as Heighington School and playground which is governed by the Scheme dated 24 July 1995 as amended on 2 December 2020. The proposed change will amend the purpose of the Heritage Rooms to be: 

26. Use of property. Subject as herein otherwise provided, the Managing Trustees shall appropriate and use the:
i lands with the buildings specified in paragraph one of the schedule to the Scheme for the purpose of furthering the religious, educational and other charitable work of the Church of England in the area of benefit; and
ii the lands and buildings specified in paragraph two of schedule to the Scheme for:
a) the purpose of furthering the religious, educational and other charitable work of the Church of England in the area of benefit; and
b) to the extent that they cannot be used for the purpose in (a) then for the benefit of the residents of the area of benefit and the neighbourhood, without distinction of sex, sexual orientation, race or of political, religious or other opinions by associating together the said residents and the local authorities, voluntary and other organisations in a common effort to advance education and to provide facilities in the interests of social welfare for recreation and leisure time occupation including artistic, craft and cultural activities with the objective of improving the conditions of life for the residents.

SCHEDULE
The following adjoining lands situate at Heighington in the County of Lincolnshire:
1. Land containing 125.42 square metres or thereabouts with the building thereon known as the Chapel of Ease.
2. Land containing 1505 square metres or thereabouts with the building thereon known as theformer Heighington School and playground.

Background information: The Heritage Rooms were previously leased to North Kesteven District Council to operate as a specialised community centre for "local heritage purposes" including "practical activities, exhibitions and exhibition workshops" on a not for profit basis. This lease ran from 1993 to 2018. The Heritage Rooms reverted to the Charity on expiry of the lease. The proposed change to the "purpose" of the Heritage Rooms as set out above is intended to reflect the expiry of that lease but also the continuation of such artistic, craft and cultural activities at the premises. The proposed new purpose above is consistent with formal written advice provided by the Charity Commission for England and Wales. The proposed change will have no impact upon the separate charitable purpose of the adjacent chapel of ease, which will remain unchanged.
